The Redwood Falls City Council introduced the proposed ordinance at the meeting held on March 16, 2021. The Council will consider adopting the proposed ordinance at the next meeting being held on April 6, 2021.
ORDINANCE NO. 71, FOURTH SERIES
AN ORDINANCE AMENDING REDWOOD FALLS CODE OF ORDINANCES §4.07, AND REPEALING ORDINANCE NO. 124, THIRD SERIES, ADOPTED ON MARCH 3, 2009, TITLED “AN ORDINANCE ADOPTING THE 2006 EDITION OF THE INTERNATIONAL PROPERTY MAINTENANCE CODE.”
THE CITY COUNCIL OF REDWOOD FALLS ORDAINS:
SECTION 1. That Ordinance No. 124, Third Series, adopted on March 3, 2009 is hereby repealed in its entirety.
SECTION 2. That Redwood Falls City Code of Ordinances §4.07 shall be amended by amending and inserting the following provisions, in their entirety, in lieu thereof:
- 4.07 PROPERTY MAINTENANCE CODE ADOPTED.
Subd. 1. That a certain document, one copy of which is on file in the office of the City Administrator of the City of Redwood Falls, being marked and designated s the International Property Maintenance Code, 2006 Edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the City of Redwood Falls, State of Minnesota, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees thereof; and each and all of the regulations, provisions, penalties, conditions and terms of the Property Maintenance Code on file in the office of the City of Redwood Falls are hereby referred to, adopted, and made a part hereof, as if fully set out in this section, with the additions, insertions, deletions and changes, if any, prescribed in Subd. 2. below.
Subd. 2. The following sections of the International Property Maintenance Code, 2006 Edition, are hereby revised:
- Section 101.1. Insert: “City of Redwood Falls, Minnesota.”
- Section 103.5 Insert: “Fee schedule is contained in Chapter 4 of the Redwood Falls City Code.”
- Section 302.4 Insert: “Six (6) inches.”
- Section 304.14 Insert: “October 15 to April 15.”
- Section 602.3 Insert: “October 15 to April 15.”
- Section 602.4 Insert: “October 15 to April 15.”
Subd. 3. That any and all ordinances or parts of ordinances in conflict herewith are hereby repealed.
Subd. 4. That if any section, subsection, sentence, clause or phrase of this section, is for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this section. The Redwood Falls City Council hereby declares that if would have passed this section, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases be declared unconstitutional.
Subd. 5. That nothing in this section or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Subd. 3. of this section; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this section.
Subd. 6. That this section be amended to read as follows:
- 4.07 PROPERTY MAINTENANCE CODE ADOPTED. The International Property Maintenance Code, 2006 Edition, published by the International Code Council, Inc., is hereby adopted by reference as though set forth verbatim herein. One copy of the Code shall be marked CITY OF REDWOOD FALLS – OFFICIAL COPY and kept on file in the office of the City Administrator and open to inspection and use by the public.
Subd. 7. This section becomes effective from and after its passage and publication.
